FIAVET ( Federazione Italiana Associazioni Imprese Viaggi e Turismo ), the Roman federation of associations of travel and tourism companies, along with CONFCOMMERCIO- Imprese per l’Italia, the Italian General Confederation of Enterprises, Professions and Self- Employment, are satisfied their requests proposed during consultations with stakeholders have been taken into consideration including the evaluations of impact with the proposed revision of the Package Travel Directive ( PTD ) which allows consumers to cancel their package and receive a complete refund “in the event of obvious and extraordinary circumstances”, and the EU Regulation on Passenger Rights law 261- 04 which grants passengers denied boarding against their will to be able either to cancel their flights, with reimbursement of their cards, or to continue them under satisfactory situations, and be properly cared for while awaiting a later flight.
” We appreciate that many of our proposals which were not that previously have been implemented now by the European Union”, stated Giuseppe Ciminnisi, President of Fiavet- Confcommercio, “among these, the commitment to charge suppliers of services included in vacation packages in favor of offer arranging agencies”.
The request remains the responsibility to reimburse the traveler in the event of departure by the travel planner, but at the same time the obligation of the suppliers, in turn, to charge the organizer of the travel package is imagined.
A new article was added which specifies that if services providers cancel or do not offer a company that is part of the package, they are obliged to deposit the administrator the obligations received for the company within 7 days. This very significant war between Fiavet and Confcommercio finds understanding in this plan.
Regarding the Italy plan to update the Rules on air traveler rights, Fiavet- Confcommercio appreciates that the centrality of the travel agency as an intermediary in ticket sales is reiterated, legitimated to reflect the customer in all aspects. Some companies may include to take note of this, abandoning laws of ostracism towards the group.
Ciminnisi even noted that there is a restriction on developments, but it is limited to the restoration of the 25 % progress that was canceled with the 2015 update. It is not a totally acceptable provision, but definitely better than the intrusion of a ban on advances which Fiavet- Confcommercio had violently asked not to include. Also, higher payments may be required if this is necessary to ensure the business and implementation of the deal, and this rule does not apply to go gift items.
Another request from Fiavet- Confcommercio that was implemented is the introduction of tickets.
The card represents a device that guarantees companies from cash problems and at the same time gives the customer a legal instrument for the treatment of their breaks.
In the novel request, the card is reintroduced as a form of insurance, with the duties, in the event of non- use, to charge the passenger in monetary form. It is still envisaged as an opportunity at the choice of the buyer, but the plan provides the opportunity to provide improving modifications before it reaches Parliament.
Eventually, the plan provides that 5 years after its passage into force, the Commission may provide a report to the European Parliament and the Council on the application of the law, taking into account its effect on SMEs.
” All alterations seem to us to be in line with the proposals of Fiavet- Confcommercio, reiterated a few days ago in the email to the President of the European Commission Ursula von der Leyen, to the Minister of Tourism, Daniela Santanchè, to the Mind of the Roman group of the European Parliament, to the European Members ( Model European Parliament ) in the Transport and Tourism Commission, at the ECTAA”.
Giuseppe Ciminnisi concluded by saying in reference to the European Travel Agents ‘ and Tour Operators ‘ Associations,” Considering that we are still in the plan step and that a approach will follow with the amendments deemed essential, we can say that we started from a good base, truly innovative, but participatory and shared beyond expectations”.
